Terms of Service — MedMate

1. Acceptance of These Terms

By downloading, installing, or using MedMate (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the App.

These Terms apply to all versions of MedMate available on Google Play and the Apple App Store under bundle ID com.zibaentertainment.medmate.

These Terms should be read alongside our Privacy Policy, which explains how we handle data.

MedMate lets you add medications, set reminder schedules, log doses as taken or skipped, track streaks, snooze reminders, estimate supply run-out dates, and optionally share a weekly summary with a caretaker email address (Premium feature).

3. Medical Disclaimer — Important

MedMate is a personal productivity and reminder tool. It is provided for informational and organisational purposes only and is not a medical device, clinical decision-support tool, or healthcare service.

• MedMate does not verify the accuracy, safety, or appropriateness of any medication information you enter.
• The App does not provide dosage recommendations, drug interaction checks, or contraindication warnings.
• Reminders depend on your device functioning correctly, having sufficient battery, notifications being enabled, and an active operating system. Missed reminders are possible and should not be relied upon as the only safeguard for time-sensitive medication.
• Always consult a qualified healthcare professional — doctor, pharmacist, or nurse — for medical advice. Nothing in the App or these Terms constitutes medical advice.

ZiBa Entertainment accepts no liability for any harm, adverse health outcome, or missed dose that results from your use of or reliance on the App.

4. Eligibility

You must be at least 13 years old to use MedMate. By using the App you confirm that you meet this requirement. If you are under 18, a parent or guardian should review these Terms with you. The App is not targeted at, and should not be used by, children under 13.

5. Licence to Use

Subject to these Terms, ZiBa Entertainment grants you a limited, non-exclusive, non-transferable, revocable licence to install and use MedMate on devices you own or control, for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or sublicense the App or any part of it.
• Reverse-engineer, decompile, or disassemble the App except where expressly permitted by law.
• Use the App in any way that violates applicable law or these Terms.
• Attempt to extract the source code, remove proprietary notices, or create derivative works.

6. Premium Subscriptions

MedMate offers an optional Premium subscription that removes ads and unlocks additional features including the caretaker email summary. Two billing periods are available:

• Monthly (product ID: medmate_premium_monthly)
• Yearly (product ID: medmate_premium_yearly)

6.1 Billing

All billing is handled entirely by Google Play (Android) or the Apple App Store (iOS). ZiBa Entertainment never receives or stores your payment card details. Payment is charged to your store account upon confirmation of purchase.

6.2 Auto-Renewal

Subscriptions auto-renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal. Your store account will be charged for renewal within 24 hours before the end of the current period.

6.3 Cancellation

You can cancel your subscription at any time through your store account settings:

• Google Play: Google Play app → Profile → Payments & subscriptions → Subscriptions.
• Apple App Store: Settings → [Your Name] → Subscriptions.

Cancellation takes effect at the end of the current billing period. You retain Premium access until that date.

6.4 Refunds

All refund requests must be directed to the relevant store:

• Google Play: Google Play refund policy
• Apple App Store: Apple refund policy

ZiBa Entertainment does not process refunds directly and has no access to your payment information.

6.5 Price Changes

We may change the subscription price at any time. The relevant store will notify you before any price change applies to your renewal, and you can cancel if you do not accept the new price.

7. Advertising (Free Tier)

The free version of MedMate displays ads served by Google AdMob. By using the free version, you acknowledge that ads may be personalised based on your device’s advertising settings. You can opt out of personalised ads in your device settings as described in our Privacy Policy. Subscribing to Premium removes all ads.

8. Caretaker Email Feature

Premium subscribers may optionally enter a caretaker’s email address to receive a weekly medication summary. By using this feature, you confirm that:

• You have obtained the caretaker’s consent to receive these emails.
• You will not use this feature to send unsolicited messages or harass anyone.
• You accept responsibility for the accuracy of the email address you enter.

ZiBa Entertainment is not responsible for the delivery, security, or content accuracy of caretaker summary emails once they have left our sending server.

9. Your Responsibilities

You are responsible for:

• Entering accurate medication information. MedMate displays what you input — it cannot verify correctness.
• Keeping your device charged and notifications enabled so reminders can be delivered.
• Not relying solely on MedMate for time-critical medication management.
• Using the App in compliance with applicable laws.
• Keeping your device secure so others cannot access your medication data.

10. Intellectual Property

All content, design, code, graphics, and branding in MedMate are the property of ZiBa Entertainment or its licensors and are protected by copyright and intellectual property law. These Terms do not grant you any rights to ZiBa Entertainment’s intellectual property beyond the limited use licence in Section 5.

The name MedMate and the ZiBa Entertainment name and logo are proprietary to ZiBa Entertainment. You may not use them without prior written permission.

11. Disclaimers

MedMate is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, ZiBa Entertainment disclaims all warranties including, without limitation:

• That the App will be uninterrupted, error-free, or always available.
• That reminders will always fire at the scheduled time.
• That the App is suitable for any particular medical purpose.
• That the App is free of bugs, viruses, or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ZiBa Entertainment and its sole developer Zico Bakker shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of data, missed doses, adverse health outcomes, or personal injury arising from use of or inability to use the App;
• Damages arising from third-party services (AdMob, Google Play, Apple App Store).

Where liability cannot be excluded by law (e.g. for gross negligence or wilful misconduct), our liability is limited to the greater of (a) the amount you paid us for Premium in the 12 months prior to the claim, or (b) €50.

Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law in your jurisdiction.

13. Indemnification

You agree to defend and hold harmless ZiBa Entertainment and Zico Bakker from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party’s rights.

14. Third-Party Services

MedMate integrates Google AdMob (advertising), Google Play Billing and Apple In-App Purchase (subscriptions), and uses an email sending service for the caretaker summary. These services are governed by their own terms and privacy policies. ZiBa Entertainment is not responsible for the conduct or practices of these third parties.

15. Changes to the App & These Terms

We may update MedMate, add or remove features, or modify these Terms at any time. Material changes to the Terms will be reflected by an updated “Effective date” on this page. The current version is always available at the URL where you found this document and linked from the App’s store listings.

Continued use of MedMate after changes are posted constitutes your acceptance of the revised Terms. If you do not accept the new Terms, please stop using the App and cancel any active subscription.

16. Termination

You may stop using MedMate at any time by uninstalling it and cancelling any active subscription.

We reserve the right to suspend or discontinue the App (or any feature of it) at any time, with or without notice, for any reason including technical, legal, or business reasons. If we discontinue the App while you hold an active paid subscription, we will work with the relevant store on an appropriate remedy.

17. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of MedMate shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

If you are a consumer in the EU, you also retain the protection of the mandatory consumer protection laws of your country of residence, and you may use the EU Online Dispute Resolution platform to resolve disputes.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
